1.1. Definitions

PlayCherry Limited is a company duly registered under the laws of Malta; Registration C43059; licensed by MGA under the following licenses: MGA/CL1/824/2012 and MGA/CL1/825/2012 (issued on 4th October 2012), MGA/CL1/850/2012 (issued on 27th May 2013), MGA/CL1/905/2013 (issued on 17th March 2014) and MGA/CL1/975/2014 (issued on 2nd June 2014);

Registered Office: 8th Floor, Tagliaferro Business Centre, 14 Gaiety Lane, c/w High Street, Sliema, SLM1551, Malta;

The term CherryCasino shall mean and refer to PlayCherry Limited;

All references to the Authority in this document shall be deemed to refer to the Malta Gaming Authority ("MGA");

Agreement shall refer to the rules and terms of conduct contained in these Terms and Conditions;

Gaming shall have the same meaning attributed to it as in Legal Notice 176 of 2004 and shall refer to any agreement, scheme or arrangement between us and any other party to play together at a game of chance in which a prize or reward consisting of money or some other item of value, worth, advantage, or opportunity is offered or can be won and become the property of the winner under defined conditions established for the purpose of the game;

Player shall mean any person who is over eighteen (18) years of age and who takes part in remote gaming as defined above;

Player's Account shall mean a record kept by CherryCasino, which record shall be at all times accessible to the Player, which shows the Player's credit against such license holder, taking into account all wagers placed and all prizes won by such Player and any other debit or credits as may be permitted by these regulations and approved by the Authority;

Any reference to Games in this agreement shall refer to Casino and other Games as may from time to time become available on the Website. CherryCasino reserves the right to add and remove Games from the Website at its own discretion.

Words denoting the singular number shall include the plural and vice versa;

Words denoting any gender shall include all genders;

Clause headings are for ease of reference only and shall not affect the construction or interpretation of this Agreement.

1.2. Preamble

This Agreement is drawn up in the English language and may be translated into any language other than English provided that all versions reflect the same principles. In case of any discrepancies in interpretation the English text shall in any event prevail.

This Agreement supersedes all previous undertakings and arrangements entered into between the Parties (whether expressed or implied) and represents the entire Agreement between them in relation to its subject matter.

In the event that any of the terms, conditions or provisions contained in this Agreement shall be determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision shall to that extent be severed from the remaining terms, conditions and provisions which shall continue to be valid to the fullest extent permitted by law. CherryCasino hereby agrees to attempt to substitute any invalid or unenforceable provision with a valid or enforceable provision which achieves to the greatest extent possible the economic, legal and commercial objectives of the invalid or unenforceable provision.

Any changes to the Agreement will be notified to the Player in advance. The Player shall have the right to refuse to accept the changes and in such case must notify CherryCasino by email to support@cherrycasino.com in which case his account shall be closed in accordance with the terms of this agreement. Default of such email shall amount to tacit approval of such changes.

1.3. Applicable law

This agreement is regulated by the laws of Malta.

CherryCasino is licensed and regulated in Malta by the Malta Gaming Authority. The MGA is the regulatory body for all forms of gaming in Malta. A Player has the right to bring unresolved disputes to the MGA via support.mga@mga.org.mt. For further information about the MGA, please go to www.mga.org.mt.

Any legal dispute shall be settled in accordance with the Governing Law of Malta.

1.4. Changes in gaming rules, Terms and Conditions

Changes to the Terms and Conditions will be notified to players in advance, who must acknowledge the changes in order to maintain their account

1.5. Duration

This Agreement is valid until further notice.

2.1. Conditions

CherryCasino reserves the right to terminate and/or change bonuses and promotions at any time.

CherryCasino reserves the right to withhold and remove any bonuses awarded to the Player if such bonuses have not been used within 3 month from the date when they were awarded.

All bonuses issued by CherryCasino can only be used for playing and may not be transferred or paid out unless stated requirements within the bonus campaign are fulfilled.

The Player acknowledges and understands that separate terms and conditions exist with respect to promotions, bonuses and special offers, and are in addition to this Agreement. These terms are outlined in the relevant promotions pages.

All bonuses have an expiry date. If the bonus requirements are not fulfilled at the expiry date, the company reserves the right to cancel or debit the bonus credits from the account.

CherryCasino reserves the right to cancel/change/stop marketing promotions at any time without prior notice.

The Player may receive bonus money from the company should he agree to participate in a bonus promotion. The bonus money granted together with the real money that was used as qualification for the bonus money will be marked as applicable for game play in respect of that particular bonus only. This balance can only be used on products and games that are outlined in the bonus details page. 

The player has the right to cancel a bonus offer from his/her account. In this case all winnings generated by the bonus money will also be cancelled.

Multiple participations to the same bonus campaign from the same device/household/IP address are not allowed. In case it is noted that there is abuse of bonuses or any other promotions, the bonus/promotion will be forfeited and any funds on the Players’ Account will be frozen. Furthermore, the Player Account may be closed by CherryCasino at its own discretion.

Voucher codes distributed by CherryCasino trigger a bonus promotion to the player account where the voucher is used.

PLAYCHERRY reserves the right to withdraw any bonus money and VIP points from the Player's Account if the player has not logged in to his/her player account during the last six months.

CherryCasino reserves the right to withdraw the Bonus and the resulting profits if any term of the offer or promotion have been breached, furthermore, it may also withhold any other funds held in the player's account to make up for any losses incurred by CherryCasino due to the breach of the said conditions.

If the conditions above have been translated into various languages and these reflect the same principles, however, in case of any discrepancies between the different language versions, the English version shall prevail.

3.1. System errors and failures

A Player must inform CherryCasino as soon as he or she becomes aware of any errors with respect to the Player Account or any calculations with respect to any bet placed or any currency conversion.

In the event of any system failure or game error (a divergence from the normal functioning of the game logic for whatever reason) that results in an error in any odds calculation, charges, fees, bonuses or payout, or any currency conversion as applicable, ('System Error'), CherryCasino will seek to place all parties directly affected by such System Error in the position they were in before the System Error occurred.

CherryCasino reserves the right to declare null and void any bets that were the subject of such System Error and to take any money from the Account relating to the relevant bets. In all circumstances whereby CherryCasino (in its sole discretion) determines a System Error has been used to gain an unfair advantage, CherryCasino reserves the right to consider this activity to be subject forfeiture and account closure as per these Terms and Conditions.

3.2. Miscarried and aborted games

CherryCasino is not liable for any downtime, server disruptions, lagging, or any technical or political disturbance to the game play. Refunds may be given solely at the discretion of the management.

CherryCasino shall accept no liability for any damages or losses which are deemed or alleged to have arisen out of or in connection with website or its content; including without limitation, delays or interruptions in operation or transmission, loss or corruption of data, communication or lines failure, any person's misuse of the site or its content or any errors or omissions in content.

In the event of a casino system malfunction all wagers are void. Should this situation apply, CherryCasino reserves the right to terminate events and/or games.

In the event a game is started but miscarries because of a failure of the system, CherryCasino shall refund the amount wagered in the game to the Player by crediting it to the Player Account or, if the account no longer exists, by paying it to the Payer in an approved manner; and if the Player has an accrued credit at the time the game miscarried, credit to Player’s Account the monetary value of the credit or, if the account no longer exists, pay it to the Player in an approved manner.

3.3. Other limitations of liability

CherryCasino is not responsible for:

  • Support of software or any accessories, attachments, machines, systems or other items;
  • Rectification of lost or corrupt data or programs arising for any reason;
  • Diagnosis and/or rectification of potential malfunctions or actual faults;
  • Corrections or data corruptions caused by third party software or software written by the Player, its agents or sub-Contractors.

CherryCasino provides no warranty or guarantee as to the suitability or quality of any goods or services supplied and the Player acknowledges that he has sole responsibility for the selection of them. Except as expressly provided in this Agreement, all conditions, representations and warranties (expressed or implied, statutory or otherwise) are excluded to the fullest extent permitted by law including without limitation any implied warranties or conditions as to quality or fitness for purpose.

CherryCasino shall not be liable for the following loss or damage howsoever caused and even if foreseeable:

  • Economic loss, which term shall include loss of profits, loss of use of profits, business, revenue, goodwill or anticipated savings;
  • Loss of, damage to or the cost of replacement, recovery or reconstruction of the Player's or a third party's documents, tapes, records, information or other data on any media;
  • Special, indirect or consequential loss;
  • Loss arising from any claim made against the Player by a third party;
  • Loss or damage arising from the Player's failure to fulfil his responsibilities or any matter under the control of the Player or a third party;
  • Loss or damage arising from CherryCasino acting in accordance with the instructions of the Player, agents or third parties engaged by the Player.

Neither CherryCasino nor the Player shall be liable for any loss or damage caused by delay or failure to fulfil its obligations under this Agreement where such delay or failure is due to any cause beyond the control of the parties, as the case may be, including (without limitation) acts of God, war or warlike action, civil disorder, insurrections or riots, fire, storm, flood, explosions, earthquakes, epidemics or quarantine restrictions, sabotage, government disorders, priorities or regulations affecting materials or facilities, court orders, restrictions as a consequence of decision or view taken by any governmental body or similar, strikes actual or threatened, labour troubles causing cessation, slowdown or interruption of work, inability to obtain necessary governmental or regulatory Authority approval, delay or cancellation of any commercial air service, or any cause to the extent it is beyond the parties' reasonable control.

Each Player is personally responsible for adhering to all applicable local legislation and rules as set out by national or local authorities from time to time. CherryCasino does not accept play from Players domiciled in the US or Players depositing using an US bank connection.

4.1. Account registration

To open a Player Account with CherryCasino the Player personally has to complete the online form and supply CherryCasino with the following:

  • Full name;
  • Nickname;
  • Address;
  • City;
  • Post code;
  • Country;
  • Contact email;
  • Phone number;
  • Date of birth - confirming that the Player is over 18 years of age.

The Player must keep the Account details up to date and can do so by modifying 'My Profile' under the ‘My Account tab or by sending an email to support@cherrycasino.com for help.

CherryCasino does not accept Player registrations and / or deposits and / or play from the following countries: American Samoa, Australia, Bonaire, Canada, France, French Guiana, French Polynesia, Guadeloupe, Guam, Hungary, Martinique, New Caledonia, Reunion, Saint Barthelemy, Saint Martin (French), Saint Pierre and Miquelon, East Timor, United States of America, Wallis and Futuna, Italy, Spain, the Netherlands, Denmark, Israel, Belgium, United Kingdom, Thailand, Portugal, Poland, Turkey, Slovenia, and the Czech Republic.

Successful registration means requesting that CherryCasino opens a gaming account for the Player. CherryCasino shall open an account when requested as long as CherryCasino’s requirements are met and reserves the right to decline account opening for any reason. The account is intended for administering the Player's funds, play and fees, as well as tickets in play, refunds, winning payments, cash-outs and eventual service fees for the duration of the Agreement. The account is for use by the Player only and Players must have only one Player account. Players are prohibited from the selling/transferring and/or acquiring of accounts or funds to/from other Players.

CherryCasino allows only two account registrations per household and a Player is only allowed one account. If CherryCasino notice that your household has more than two accounts, CherryCasino may block or close any or all of the accounts at its discretion. If three or more Players share the same household, it is the Players responsibility to inform CherryCasino about this.

In the event of a Player's death or permanent incapacity, CherryCasino requires a copy of the death certificate or a registered medical physician's statement and any other documents relating to administration or guardianship of the estate as proof of the Player's successor's or guardian's (jointly referred to as "Beneficiaries") entitlement. In this event, any of the Player's income rights and/or the value of the Player Account may be passed to the Beneficiaries.

CherryCasino reserves the right to monitor Player Account activities and notify the Player if CherryCasino believes he or she may have gambling problems. However, CherryCasino makes no warranties about its ability to identify and help a Player with gambling problems. The Player may request to be excluded from entering or using the CherryCasino web application for various reasons and may do so at any time by sending a request to support@cherrycasino.com.

CherryCasino reserves the right to refuse or close any application for a Player's Account. Any contractual obligations already made will be honoured.

4.2. Username and Password

Username and password are provided as a part of the registration procedure. At registration, the Player chooses a username and password. (The e-mail address supplied becomes the username.)

These details shall only be effective on acceptance of this Terms and Conditions by the Player. The Player accepts that the Player is solely responsible for maintaining the confidentiality of the Player's username and password, and shall store the username and password in such a manner that outside persons cannot gain access to them.

The Player is responsible for immediately contacting Customer Services, if there is a risk that the Player's username or password may be compromised in any way. Please contact CherryCasino by sending a message to support@cherrycasino.com, if you suspect anything.

CherryCasino reserves the right to temporarily lock the account under such conditions. The Player remains fully responsible for all play based on the Player's username and password until such locking of the Player's Account.

CherryCasino reserves the right to inactivate a Player's username and password at any time.

5.1. Handling and accounting for deposits

Registered Players can deposit funds using a VISA or MasterCard, by bank transfers or through e-wallets like Moneybookers and Neteller. The minimum deposit is €20. Once the deposit is processed it will be available on the Player's account immediately after approval. Bank transfers will not be credited to the Player account until the funds have reached our bank. CherryCasino does not impose any fees on deposits; however we are not liable for any fees charged by the Player's bank for online purchases. Information regarding deposit limits and processing times can also be found in the payments section. The Player may be requested to provide CherryCasino with personal documentation, such as but not limited to copies of identification documents, utility bills, credit cards, bank statements etc

Funds deposited by Players shall be separately accounted for. CherryCasino separates deposits from its other funds and keeps Player deposits in a separate bank account. The Player hereby accepts that CherryCasino stores the deposited funds together with other Players' funds and that separation is only provided by electronic accounting methods. Acceptance of Player’s deposit shall be subject to the Player successfully completing CherryCasino’s “Know Your Client" procedures which shall be carried out on all Players depositing money.

Players are not allowed to make deposits with funds that have been obtained by ill-gotten means. Players are also advised that all transactions are monitored for irregularities and to prevent money laundering and fraud. CherryCasino has an obligation to report suspicious transactions to the appropriate authorities.

CherryCasino will not accept a wager from a player unless there are sufficient funds in the Player's Account to cover the amount of the wager. CherryCasino reserves the right to refuse or limit any wager.

Depending on the payment method used, eWallets and bank transfers will qualify immediately after receipt for withdrawal, whilst VISA or Mastercard payments will only qualify for withdrawal after having completed the full KYC procedures.

Deposits and withdrawals of funds into and from Your Player Account, shall only be made using credit card and other financial instruments that are valid and lawfully belonging to You.

When funds in a Player Account are being used to play Games, deposited funds will be debited first, thereafter other funds (like bonuses and free spins).

5.1.1. General Conditions of Use E-voucher applying to Epro solution

  • E-PRO is a payment solution provided by EMP Corp, an E-money agent, based on E-money and E- wallet

5.2. Interest on deposited funds

The Player shall not treat CherryCasino as a financial institution and is not entitled to any interest on deposited funds and will be paid no interest on deposited funds.

5.3. Player access to funds stored in the Player's Account

CherryCasino shall action a transfer from the Player's Account a part or whole of the Player's funds, with deductions for eventual service fees, bank fees etc. to the bank account, credit card or e-wallet that the Player most recently registered at CherryCasino. Transfers are administered only during working hours set out by CherryCasino from time to time. Requests for transfers can be made at any time.

5.4. No loans and no exchange rate speculation

Funds on a Player's Account cannot be used as a basis for obtaining any form of credit, nor are they allowed to be used for exchange rate speculation. CherryCasino reserves the right to return funds to Players at the original exchange rate if CherryCasino has reasonable suspicion that the intent of the Player's transactions has been primarily to speculate on exchange rates or for any other purposes than to participate in the Games.

6.1. Withdrawal procedures

The Player may be requested a list of required documents before making a withdrawal request. CherryCasino will endeavour to process all requested withdrawals within 72 hours, providing that verification documents have been received. CherryCasino reserves the right to refuse a withdrawal and request additional documents by email. Bonus money will not be paid out from the Player's Account. Any withdrawal can be subject to random security checks to prevent fraudulent activity and money laundering.

CherryCasino reserves the right to ask for verification documents at any time, and we can temporarily suspend your account until we receive the required documents. CherryCasino carries out additional verification procedures and players having cumulative withdrawals exceeding 2,330 Euro will be requested to provide CherryCasino with personal documentation, such as but not limited to copies of identification documents, utility bills, credit cards, bank statements etc. A Player's Account might be closed permanently and or a withdrawal may be refused if a player does not provide CherryCasino with the required documents and or if the player is found to have supplied false or misleading information.

All documents that are sent to CherryCasino are confidential and will be handled under the data protection regulations (Malta Data Protection Act Cap.440). The reason why CherryCasino requires these documents is to guarantee the security for all Players and to prevent money laundering.

If the Player closes the Player's Account, all funds excluding any bonus money that might not be redeemable will be transferred to the bank account from where the funds originated.

CherryCasino actively endeavours to combat money laundering. Withdrawals from a Player's Account to the player will be made to the account from which the transfer to the Player's Account was made.

In case where remittance of funds to an account from which deposits originated is not possible, withdrawals will be made to another account of choice following certain controls including but not limited to due diligence checks, anti-money laundering checks and anti-fraud checks.

It is the Players’ responsibility to provide sufficient and accurate banking information for CherryCasino to complete a transaction. If the information is not sufficient and accurate any additional fees or charges will be levied on the player.

The minimum amount that can be withdrawn is €20. Credit card or e-wallet transfers are not subjected to any fee. Bank transfer fees may vary and will be deducted from the withdrawal amount.

Deposits and withdrawals of funds into and from Your Player Account, shall only be made using credit card and other financial instruments that are valid and lawfully belonging to You.

CherryCasino is required to retrieve a proof of the Player's identity for large withdrawals, in which case CherryCasino will contact the Player. CherryCasino will process the withdrawal once satisfactory proof has been received.

Each Player is solely responsible for reporting and paying any taxes as required by the governing law of the country of residence, if applicable.

Withdrawal of funds not used for wagering/betting shall not be allowed.

7.1. The Player's ability to suspend the Player's Account

The Player can request suspension of the Player's Account for an arbitrary period of time. Excessive use of the suspend account feature, as set out by CherryCasino at any time, may at CherryCasino’s sole discretion lead to termination of the customer relationship at any time. The Player may set a limit / suspension on the account at any time by going to My Account and Restrictions (requires log in) to enter a limit for how much he/she can spend per week until a date in the future. Once saved, this will come into effect immediately.

7.2. The Player's ability to lock the Player's Account

The Player can request that the Player's Account is locked at any time. CherryCasino shall handle such requests during working hours as set out by CherryCasino from time to time. The Player may lock the account at any time by going to Account and Restrictions (requires log in) to enter a future date when the lock should expire. Once saved, this will come into effect immediately.

7.3. Revoking or changing a suspension or lock on a Player Account

The Player may request that a suspension or a lock set on a Player account to be changed or revoked. Such a request has to be submitted to CherryCasino in writing.

A request for decreasing the suspension or revoking the lock will not come into effect until 7 days after the request was submitted. Should a Player request to increase the exclusion period, this will come into effect immediately.

7.4. Inactive Accounts

A Player account is deemed to be inactive if no transactions have been associated with that account during an uninterrupted period of 30 months. CherryCasino reserves the right to terminate the customer relationship automatically once an account is inactive. The Account will also be terminated should it be blocked or excluded beyond the before mentioned period of inactivity.

Any funds available on the Player Account will be returned to the last known VISA card, bank connection or e-wallet of the Player. If this information is obsolete or CherryCasino cannot retrieve any new details, the Account will be closed and funds will be transferred to the MGA. Once funds are transferred to the MGA the player should contact the MGA to recover his funds.

CherryCasino will not charge for any fees related to inactive/dormant accounts.

7.5. Recovery of funds on accounts

To recover funds on an account the player should request a withdrawal via the normal process or if such process is not possible the player should contact customer support.

8.1. Setting limits

As a responsible gaming measure, the Player has the ability to place financial limits on the amount of wagers and deposits. In the responsible gaming area under “My Account” the Player can set limits for daily, weekly and monthly deposits.

A requested limit will have effect immediately the first time it is submitted or in case a prior limit is lowered. If the limit amount is increased or terminated, such change will have effect after a seven day cooling down period. A limit set by the player will be in effect until the player decides otherwise.

The player can, as well, establish session limits after which will be prompted to logout or continue playing. Self exclusion periods are available under the “My account” area of the site.

The player may close his player’s account by sending such a request to our customer support team. The customer support team will then finalize the closing of the player’s account. The player will be able to open his/her account again by sending a request to the customer support team. CherryCasino will open the Player’s Account again after seven days after CherryCasino has received such request.

9.1. Collection of personal data

CherryCasino is committed to protect your privacy and personal information. Personal and financial information of all players will be kept confidential. However, under applicable laws and gaming regulations CherryCasino is required to maintain a secure online list of all registered players which may be disclosed to the Authorities for scrutiny purposes. Hence personal data needed to identify a Player and such player's gaming transactions will not be deleted even if a Player's Account is closed. CherryCasino may retain such information for the period that is required in accordance with applicable laws and gaming regulations.

CherryCasino website requires storing of small pieces of data, namely cookies, on the Players´ hard drive. Cookies are used to provide a better gaming experience and faster browsing for the player. Usage of a cookie is in no way linked to any personal information of the Player. Please note that CherryCasino website can´t be used properly while cookies are disabled.

9.2. Access to personal data

Customer Service representatives and other representatives of CherryCasino may have access to the above mentioned data in order to provide quality customer service and to administer our business activities.

For the purposes of applicable data protection legislation the Player hereby consents to the processing of any and all personal data (in manual, electronic or any other form) in connection with the Player's transactions in relation to CherryCasino. With the Players' approval CherryCasino may use personal details for marketing purposes. CherryCasino undertakes that it shall not process any personal data relative to the Player for any purpose other than for administrating the Player's transactions with CherryCasino and marketing as approved by the Player.

CherryCasino also has the right to disclose the Player's personal information to relevant recipients if it is required to do so by law, or if CherryCasino believes in good faith that such disclosure is necessary to: (1) comply with and legal process served on the licensee or its gaming service; (2) protect the safety of other users of the gaming service or the public ; (3) investigate any suspected violations of the terms & conditions or license agreement, fraud or other similar and/or unlawful activity performed by the player.

10.1. Anti-Money laundry procedures

CherryCasino complies with the Prevention of Money Laundering Act and Regulations issued thereunder. CherryCasino shall report any suspicious transaction to the relevant competent authorities in Malta.

If the Player becomes aware of any suspicious activity relating to any of the Games of the Website, the Player must report this to CherryCasino immediately.

All transactions will be scrubbed by the system and checked using fraud tools available to help prevent any Money Laundry activity/attempt.

10.2. Fair-Play

CherryCasino prohibits player collusion and takes measures to prohibit use of devices, such as robots, that distort normal game play.

10.3. Consequences

CherryCasino may suspend, block or close the Player’s Account and withhold funds if requested to do so by the relevant authorities in accordance with the Prevention of Money Laundering Act or in the event that CherryCasino itself reasonably suspects that the Player is in breach of the Prevention of Money Laundering Act of Fair-Play rules. CherryCasino may also suspend, block or close the Player’s Account in the event of breach of any of the terms and conditions of this Agreement by the Player. Such suspension/blockage or closure shall not prejudice any of the Player’s rights lawfully obtained.

11.1. Transaction queries and limitation

Transactions can be queried at any time. Claims and requests to refute a transaction shall be made within thirty (30) days of the transaction in question and will be reviewed and actioned accordingly. Failure to query or refute a transaction within thirty (30) days leads to the transaction being deemed valid and irrevocable. Decision taken by PlayCherry is final and binding.

11.2. Complaints and compensation

If a Player has any complaints, claims or disputes with regard to any outcome regarding the services or any other activity provided by CherryCasino, he/she must submit the complaint to CherryCasino in writing as soon as is reasonably practicable following the date of the original transaction to which the claim or dispute refers and within the time limit set out in the previous paragraph.

The Player agrees that he or she will only use the services provided by CherryCasino in accordance with the Terms and Condition set out in this schedule. Any breach of these conditions by the Player which results in CherryCasino incurring any losses or costs will render the Player liable to compensate CherryCasino for any said losses or costs in their entirety.

1. Introduction

When the Operator is placing the Bets with the Bookmaker in Curacao, the Player acknowledges that the Operator is acting in the name and on behalf of the Player. The Bookmaker sets the odds of winning and pays the Winnings to the Operator on behalf of the Player for the eventual payout to the Player.

2. Definitions

“Bet” – a bet on the outcome of an event with a determinable outcome, for example the result of a lottery offered by the Website

“Bookmaker” – Kootac N.V., a company which is officially licensed by the Government of Curacao to accept Bets on lotteries (license number #8048/JAZ2013-014). The Bookmaker acts as a bookmaker by determining the odds, and is also responsible for the payment of Winnings to the Operator for distribution to Players. “Booster Ball” – a function allowing players to place bets on matching the correct numbers with vastly improved odds to those normally offered.

“Boost-o-meter” – a slider where players can adjust their stake when playing the Booster Ball.

“DLTB” – members of the German lottery and pools who operate several lotteries, including the German lottery “Lotto 6 aus 49”.

“DLTB-Jackpot” – the aggregate amount payable by the DLTB in respect of all Winning Tickets in Prize Category 1 and/or 2 in respect of the relevant draw of the German lottery “Lotto 6 aus 49”, as announced by the DLTB or, in a condition where no such Winning Tickets are announced, the amount that would have been payable by the DLTB had there been a Winning Ticket in the relevant Prize Category/Categories and in respect of the relevant draw of the German “Lotto 6 aus 49”.

“DLTB Winning Ticket” – a winning ticket for each draw, organised by the DLTB ‘’Lotto 6 aus 49’’

“Euro Jackpot-Jackpot” – the aggregate amount payable by the DLTB or any co-organiser in respect of all Winning Tickets in Prize Category 1 in respect of the relevant draw of the lottery “Euro Jackpot”, as announced by the DLTB or any co-organiser or, in a condition where no such Winning Tickets are announced, the amount that would have been payable by the DLTB or any co-organiser had there been a Winning Ticket in Prize Category 1 in respect of the relevant draw.

“Euro Jackpot Winning Ticket” – a successfully submitted and accepted Winning Ticket for the “Euro Jackpot” lottery in respect of the relevant and official draw.

“Euro Millionen-Jackpot” – the aggregate amount payable by the LAE or any co-organiser in respect of all Winning Tickets in Prize Category 1 in respect of the relevant draw of the lottery “Euro Millionen”, as announced by the LAE or any co-organiser or, in a condition where no such Winning Tickets are announced, the amount that would have been payable by the LAE or any co-organiser had there been a Winning Ticket in Prize Category 1 in respect of the relevant draw.

“Euro Millionen Winning Ticket” – a successfully submitted and accepted Winning Ticket for the “Euro Millionen” lottery in respect of the relevant and official draw.

“Jackpot” – the maximum possible winning at the Operator in respect to the underlying draw of the relevant Prize Category/Prize Categories of the relevant lotteries or the sum thereof.

“Operator” –  CHERRYCASINO

“Operator Winning Bet” – a winning Bet for a Bookmaker game, which was successfully submitted directly or indirectly, via Internet, telephone or other channels, and placed by Operator on behalf of the Player with Bookmaker, including possible winning Bets introduced through a third party to Operator and then placed by Operator on behalf of the Player with Bookmaker.

“Mega Millions-Jackpot” – the aggregate amount payable by the Mega Millions Consortium or MUSL or any (co-)organiser in respect of all Winning Tickets in Prize Category 1 in US dollars and in respect of the relevant draw of the US-lottery “Mega Millions”, paid out in 30 growing annual amounts according to the official rules (i.e. with 5%p.a.), or, in a condition where no such Winning Tickets are announced, the amount that would have been payable by the Mega Millions Consortium, MUSL or a (co-)organiser over 30 growing annual amounts (in case of the “annuity” option) had there been a Winning Ticket in Prize Category 1 in respect of the relevant draw.

“Mega Millions Winning Ticket” – a successfully submitted and accepted Winning Ticket for the American “Mega Millions” lottery in respect of the relevant and official draw.

“MUSL” – the Multi-State Lottery Association, which organises shared lotteries including the “Powerball” and “Mega Millions” lotteries.

“Pay Out” – the amount, which the operator of a lottery underlying a Bookmaker game in respect to a correctly matched Bet of a relevant draw in a relevant Prize Category has to pay out or has already paid out.

“Powerball-Jackpot” – the aggregate amount payable by the MUSL or any (co-) organiser in respect of all Winning Tickets in Prize Category 1 in US dollars and in respect of the relevant draw of the US-lottery “Powerball”, paid out in 30 growing annual amounts according to the official rules (i.e. with 4% p.a.), or, in a condition where no such Winning Tickets are announced, the amount that would have been payable by the MUSL or any (co-)organiser over 30 growing annual amounts (in case of the “annuity” option) had there been a Winning Ticket in Prize Category 1 in respect of the relevant draw.

“Powerball Winning Ticket” – a successfully submitted and accepted Winning Ticket for the American “Powerball” lottery in respect of the relevant and official draw.

“Superenalotto-Jackpot” – the amount payable by the organiser of Italian lottery (Sisal) under the name Superenalotto in respect of all Winning Tickets in Prize Category 1 in and in respect of the relevant draw of the “Superenalotto” lottery, as announced by the Italian lottery organizer, had there been a Winning Ticket in Prize Category 1 in respect of the relevant draw.

“Superenalotto Winning Ticket” – a successfully submitted and accepted Winning Ticket for the Italian “SuperEnaLotto” lottery in respect of the relevant and official draw.

“Prize Category” or “Prize Tier” – the category relates to the amount of numbers correctly matched (including Super Numbers, Stars, Euro Numbers, Powerballs, Megaballs and/or Bonus Balls as applicable) and which result determines the Prize Category in respect of the relevant draw of a certain lottery or a related Bookmaker game.

 “Stake” – the sum of money the Player places on a bet in respect of a relevant game and for a certain Virtual Betting Ticket, including any service fees.

“Virtual Betting Ticket” – the electronic ticket displayer on the Website the compilation of which allows him to place bets on a lottery or lotteries of his choice.

“Website” – the Internet portal of the Operator, which is available at CherryCasino.com, and which may refer to other joint or mobile Websites, which are also operated by the Operator within the same or another domain or within the same or another brand, and any subdomains operated by the Operator.

3. Contractual Parties

When a Player participates in any game offered on the Website the Player is accepting to enter into two separate agreements as described below:

  1. When registering, and when placing an order for a bet, the Player is entering into a contract with the Operator for the following services: the use of the Website; the operation and management of the Player Account; the placing of Bets with the Bookmaker in Curacao on the Player’s behalf; the payment of the Player’s Stakes to the Bookmaker; and, the payout of any Winnings received from the Bookmaker to the Player.
  2. When the Operator places a bet with the Bookmaker on a Player’s behalf, the Player is directly entering into a contract with the Bookmaker which regulates the Terms and Conditions for all Bets placed; the rules of the games offered by the Bookmaker as well as the payout of any Winnings.

All references in these Terms and Conditions in relation to a Player placing a Bet or in relation to the placement of Bets refer to, unless otherwise regulated, the placing of a Bet by the Operator with the Bookmaker for and on behalf of the Player in Curacao.

5. Placing of Bets

5.1.

The Player effects an instruction to the Operator to place Bets with the Bookmaker on their behalf by filling out and submitting a Virtual Betting Ticket on the Website for their chosen Bookmaker Game/s.

To settle the Bet amount the Player may either use funds available in his Player Account or pay for the Bet/s by using the chosen payment method during check out.

5.2.

After the Player has filled out the Virtual Betting Ticket/s, the Bet/s transfer to the Player’s shopping cart. When the Player has finished placing bets he may then proceed to the Shopping Cart to effect payment.

5.3.

The Player then pays for their Bet/s by providing their payment details and by clicking on the applicable button in the shopping cart. Where the Player has a balance in his Account and chooses to settle the Bet from his balance, the bet amount is immediately deducted from the balance. The system will indicate to the Player if there are sufficient funds available in his Player Account and whether another payment method is required to be selected or not.

5.4.

The Operator does not offer credit betting and the player must either have funds in The Player Account or pay for the bet using the chosen payment method.

5.5.

Once any Bet has been submitted, it cannot be altered or cancelled.

5.6.

The Player will then receive an Order confirmation which would include details of the Bet placed. The Player may also review the full details of all bets placed by logging into their Player Account on the website and review Bet History or Active Bets as applicable.

5.7.

Depending on the selected Bookmaker game/s, the Player may bet for a certain duration (“Duration Bets”) and also extend the duration automatically. Stakes for Duration Bets will be debited by pre-payment at the beginning of the relevant duration for all relevant draws for the selected duration.

5.8.

The Player may automatically extend Bets by selecting the “Subscription” option which is available separately for each Bookmaker Game. Depending on the selected Bookmaker game the player may then select a period for the automated placing of Bets for a period ranging from 1 to 52 weeks. After this Subscription period has elapsed the Bets are once again renewed automatically for the selected period of Subscription, unless a notice of cancellation is received via the Player Account. The cancellation of a Subscription must be received by 23:59h of the day prior to the day the period for automated placing of Bets ends. Stakes for following Subscription Bets will be debited by pre-payment for every following period of the Subscription.

5.9.

The Operator is authorised to, in its sole discretion, instruct the Bookmaker to void any Bets, whether Active or Settled if

  1. the Operator was instructed to place a Bet/s after the relevant deadline or after the start of the relevant draw and/or if the Operator incorrectly accepted an instruction to place a Bet/s on the Website after the relevant deadline or after the start of the relevant draw
  2. the Operator was instructed to place a Bet by a Player who has provided false, incomplete or expired information associated with their Player Account or otherwise related to the Website or any the services available through it
  3. the Operator becomes aware of a genuine mistake in relation to a Bet or draw and is not able to contact the Player to correct the error or confirm the Bet prior to the deadline
  4. the Operator was instructed to place a Bet by a Player who is involved in any fraud-related activities relating to the placing of the Bet, the operation of the Player Account or relating to the Website or the services offered by the Operator
  5. the Operator was instructed to place a Bet by a Player who was, at the time of placing the Bet, less than 18 years old,
  6. the Player maintains more than one Player Account,
  7. in conjunction with any draw, fraud and/or technical and/or human error or unwarranted influence was found or
  8. the draw is declared by an organiser or co-organiser as being invalid.

8. Winnings

8.1.

Winnings on any Bookmaker Game/s shall be credited to a Player Account and the Player is able to view any such Winnings on their Player Account on the Website. The Winnings will be credited once these are received by the Operator from the Bookmaker. In addition, the Operator may decide, but is not obliged, to inform the Player with respect to Winnings by email, SMS/text message or other ways especially if there is a large win. Information about Winnings can be provided in euro (€), pound sterling (£) or U.S. dollars ($).

8.3.

The Operator will only transfer those Winnings to the Player, which have been paid out by the Bookmaker to the Operator. The Operator is required to only credit Winnings to a Player Account if the Operator received the Winnings from the Bookmaker and the Player is entitled to a Winning and, where applicable, the Insurers settle a claim for a Winning.

11. The Bookmakers Betting Rules

The Bookmaker will accept Bet/s placed by the Operator on behalf of the Player, where instructions to place the Bet/s have been placed on the Website by the Player and the Bet/s has been subsequently placed with it by the Operator.

Any reference in this section of the Terms and Conditions of a Player shall mean a Player placing a bet with the Operator who is acting as the Player’s agent.

For avoidance of any doubt the Bookmaker is not a lottery operator. With the Bookmaker, the Player is placing Bets on the expected results of the drawings of certain lotteries, namely:

  • “Superenalotto”, operated by the Italian national lottery;
  • “Euro Millionen”, operated by the LAE;
  • “Euro Jackpot”, “Lotto 6 aus 49”, “Spiel 77”, “Super 6” and “Glücksspirale”, operated or co-operated by the German DLTB;
  • “Powerball” and “Mega Millions”, operated or co-operated by the US-American Mega Millions Consortium, MUSL or their co-organisers; and
  • “Lotería de Navidad”, operated by the Spanish Loterías y Apuestas del Estado.

11.1. LOTTO 6aus49

11.1.1.

LOTTO 6aus49 is a Bookmaker game based on the German “Lotto 6 aus 49” lottery; a lottery operated by the DLTB. The German “Lotto 6 aus 49” involves a random draw of six numbers (“Numbers”) selected from 1 to 49 and one supplementary “Super Number” (known as the “Superzahl”), selected from the 10 numbers 0 to 9. Draws normally take place every Wednesday and Saturday.

11.1.2.

The Player must select six numbers per Bet plus one Super Number per Virtual Betting Ticket.

11.1.3.

The Super Number is the last number of the Play Slip Number of the Virtual Betting Ticket.

11.1.4.

For every Virtual Betting Ticket at least one Bet has to be filled in.

11.1.5.

The cost for participation will be displayed on the Virtual Betting Ticket.

11.1.6.

The deadline for participating in any draw is set out for each respective draw, and will be shown on the Website.

11.1.7.

There are 9 different ways to win:

  • by matching 2 Numbers plus the Super Number (Prize Category 9)
  • by matching 3 Numbers (Prize Category 8)
  • by matching 3 Numbers plus the Super Number (Prize Category 7)
  • by matching 4 Numbers (Prize Category 6)
  • by matching 4 Numbers plus the Super Number (Prize Category 5)
  • by matching 5 Numbers (Prize Category 4)
  • by matching 5 Numbers plus the Super Number (Prize Category 3)
  • by matching, 6 Numbers (Prize Category 2)
  • by matching 6 Numbers plus the Super Number (Prize Category 1)

11.1.8.

Only one Prize Category can be won on each Bet and will be the highest of the available Prize Categories achieved by that Bet.

11.1.9.

The Winnings to be paid out in respect of each Operator Winning Bet in Prize Category 9 shall be 5,00 Euro.

11.1.10.

The Winnings to be paid out in respect of each Operator Winning Bet in Prize Categories 4 to 8 shall be the amount of the Pay Out announced by the DLTB in respect of a Lotto Winning Bet in the relevant Prize Category. If the DLTB has not announced a Pay Out in the respective Prize Category for the relevant draw of “Lotto 6 aus 49”, the Winnings payable in respect of each Operator Winning Bet in that Prize Category will be calculated on the basis of the aggregate amounts paid in for the relevant draw of “Lotto 6 aus 49” announced by the DLTB and its allocation to the winning Prize Categories. Players with Operator Winning Bets for the Prize Categories 4 to 8 are subsequently better off as their Winnings would have been smaller, had they bought a Lotto Winning Ticket instead of a Operator Winning Bet.

11.1.11.

The Winnings payable in respect of each Operator Winning Bet in Prize Category 1, 2 and 3 will depend on the number of DLTB Winning Tickets in the relevant Prize Category, the number of Operator Winning Bets in the relevant Prize Category, the payable Pay Out by the DLTB for the DLTB Winning Tickets in the relevant Prize Category as well as the DLTB-Jackpot. A Player with an Operator Winning Bet for Prize Categories 1 or 2 will be treated equally, meaning that their Winnings will be the same as the Pay Out they would have received, had they bought a DLTB Winning Ticket instead of an Operator Winning Bet.

11.1.12.

The Winnings to be paid out in respect of each Operator Winning Bet in Prize Category 1 are equal to the amount, which the DLTB would have paid, if the Player had bought a DLTB-Winning Ticket in Prize Category 1 instead. The Bookmaker will calculate this amount on the basis of the amount of aggregate stakes published by DLTB as well as the distribution to the Prize Categories or on the basis of the jackpot published on their website for Prize Category 1 of the relevant draw of the German “Lotto 6 aus 49”. Albeit 10.1.11. (clause 2) the total of all Winnings payable by Bookmaker for Prize Category 1 for a certain draw must never exceed the DLTB-Jackpot for the relevant draw and might be divided among the winners.

Example 1: There is one Operator Winning Bet in Prize Category 1 and no DLTB Winning Ticket has been declared by the DLTB in Prize Category 1 in respect of a DLTB-Jackpot of € 10.000.000,00. The Winnings payable in respect of that single Operator Winning Bet in Prize Category 1 would be € 10.000.000,00.

Example 2: There is one Operator Winning Bet in Prize Category 1 and two DLTB Winning Tickets have been declared by the DLTB in Prize Category 1 in respect of a DLTB-Jackpot of € 10.000.000,00. The Winnings payable in respect of that single Operator Winning Bet in Prize Category 1 amount to € 3.333.333,33.

Example 3: There are two Operator Winning Bets in Prize Category 1 and one DLTB Winning Ticket has been declared by the DLTB in Prize Category 1 in respect of a DLTB-Jackpot of € 10.000.000,00. The Winnings payable in respect of each Operator Winning Bet in Prize Category 1 amount to € 5.000.000,00.

11.1.13.

The Winnings to be paid out in respect of an Operator Winning Bet in Prize Category 2 are equal to the amount, which the DLTB would have paid, if the Player had bought a DLTB Winning Ticket in Prize Category 2 instead. Bookmaker will calculate this amount on the basis of the amount of aggregate stakes published by DLTB as well as the distribution to the Prize Categories or on the basis of the jackpot published on their website for Prize Category 2 of the relevant draw of the German “Lotto 6 aus 49”. If no prize is published by DLTB for the Prize Category 2, Bookmaker will fix the prize at € 100,000.

Example 1: There is one Operator Winning Bet in Prize Category 2 and no DLTB Winning Ticket has been announced by the DLTB in Prize Category 2 in respect of a theoretical Payout of € 3.000.000,00 for one DLTB Winning Ticket. The Winnings payable in respect of that single Operator Winning Bet in Prize Category 2 amount to € 3.000.000,00.

Example 2: There is one Operator Winning Bet in Prize Category 2 and two DLTB Winning Tickets have been announced by the DLTB in Prize Category 2 with a Payout of € 1.500.000,00 each. The Winnings payable in respect of that single Operator Winning Bet in Prize Category 2 would be € 1.000.000,00.

Example 3: There are two Operator Winning Bets in Prize Category 2 and one DLTB Winning Ticket has been announced by the DLTB in Prize Category 2 with a Payout of € 3.000.000,00. The Winnings payable in respect of each Operator Winning Bet in Prize Category 2 would be € 1.500.000,00.

11.1.14.

The Winnings to be paid out in respect of an Operator Winning Bet in Prize Category 3 are equal to the amount, which the DLTB would have paid, if the Player had bought a DLTB Winning Ticket in Prize Category 3 instead. Bookmaker will calculate this amount on the basis of the amount of aggregate stakes published by DLTB as well as the distribution to the Prize Categories or on the basis of the jackpot published on their website for Prize Category 2 of the relevant draw of the German “Lotto 6 aus 49”. If no prize is published by DLTB for the Prize Category 3, Bookmaker will fix the prize at € 10,000.

Example 1: There is one Operator Winning Bet in Prize Category 3 and no DLTB Winning Ticket has been announced by the DLTB in Prize Category 3 in respect of a theoretical Pay Out of € 100.000,00 for one Euro Jackpot Winning Ticket. The Winnings payable in respect of that single Operator Winning Bet in Prize Category 3 amount to € 100.000,00.

Example 2: There is one Operator Winning Bet in Prize Category 3 and two DLTB Winning Tickets have been announced by the DLTB in Prize Category 3 with a Payout of € 100.000,00 each. The Winnings payable in respect of that single Operator Winning Bet in Prize Category 3 would be € 66.666,66.

Example 3: There are two Operator Winning Bets in Prize Category 3 and one DLTB Winning Ticket has been announced by the DLTB in Prize Category 3 with a Payout of € 100.00,00. The Winnings payable in respect of each Operator Winning Bet in Prize Category 3 would be € 50.000,00.

11.1.15.

If there has been no DLTB Winning Ticket in Prize Category 1 for thirteen consecutive draws of the German “Lotto 6 aus 49”, leading to a mandatory Payout of the Prizes in Prize Category 1 to DLTB Winning Tickets in lower Prize Categories, the regulations in 11.1.10., 11.1.11., 11.1.12., 11.1.13., and 11.1.14 apply assuming that there was no mandatory payout of Prizes in Prize Category 1 to DLTB Winning Tickets in lower Prize Categories.

11.5. EuroJackpot

11.5.1.

EuroJackpot is a Bookmaker game based on the European lottery “Euro Jackpot”, which is co-operated by the DLTB. The lottery “Euro Jackpot” involves a draw of five random numbers selected from 1 to 50 and two additional numbers, selected from 1 to 10. Draws normally take place every Friday.

11.5.2.

The Player must select five Winning Numbers and two Euro Numbers per Bet. At least one Bet is required per Virtual Betting Ticket. Every field which is filled out counts as at least one separate Bet.

11.5.3.

The Stake is shown on the Virtual Betting Ticket.

11.5.4.

The deadline for participating in a draw is determined for each respective draw, and will be posted on the Website.

11.5.5.

There are 12 ways to win:

  • by matching 2 Winning Numbers and 1 Euro Number (Prize Category 12)

11.5.6.

Only one Prize Category can be won per Normal Bet, which will be the highest of the available Prize Categories achieved by, and relevant to, that Bet.

11.5.7.

The Winnings payable in respect of each Operator Winning Bet in Prize Categories 4 to 12 shall be the amount of the Pay Out announced by the DLTB or a co-operator in respect of each Euro Jackpot Winning Bet in the respective Prize Category. If the DLTB or its co-operators have not announced a Pay Out in the respective Prize Category for the relevant draw of “Euro Jackpot”, the Winnings payable in respect of each Operator Winning Bet in that Prize Category will be calculated by Bookmaker on the basis of the published aggregate amounts paid in for the relevant draw of “Euro Jackpot” announced by the DLTB or its co-operators and its allocation to the winning Prize Categories. Players with Operator Winning Bets for the Prize Categories 4 to 12 are consequently better off as their Winnings would have been smaller, had they bought an Euro Jackpot Winning Ticket instead of a Operator Winning Bet.

11.5.8.

The Winnings payable in respect of each Operator Winning Bet in Prize Categories 1, 2 and 3 will depend on the number of Euro Jackpot Winning Tickets in the relevant Prize Category, the number of Operator Winning Bets in the relevant Prize Category, the payable Prize by the DLTB or its co-operators for the Euro Jackpot Winning Tickets in the relevant Prize Category as well as the Euro Jackpot-Jackpot. A Player with a Operator Winning Bet in Prize Categories 1, 2 or 3 will be treated equally by means that their Winnings will be the same as the Pay Out they would have received, had they bought a EuroJackpot Winning Ticket instead of the Operator Winning Bet.

11.5.9.

The Winnings to be paid out in respect of each Operator Winning Bet in Prize Category 1 are equal to the amount, which the DLTB or a co-operator would have paid, if the Player had bought a Euro Jackpot Winning Ticket in Prize Category 1 instead. Operator will calculate this amount on the basis of the amount of aggregate stakes published by DLTB or its co-operators as well as the distribution to the Prize Categories or on the basis of the jackpot published on the Website of the DLTB or its co-operators for Prize Category 1 of the relevant draw of “Euro Jackpot”. As per 11.5.7. (clause 2) the total of all Winnings payable by Bookmaker for Prize Category 1 for a certain draw must never exceed the Euro Jackpot-Jackpot for the relevant draw and might be divided among the winners.

Example 1: There is only one Operator Winning Bet in Prize Category 1 and no Euro Jackpot Winning Ticket has been announced by the DLTB or a co-operator in Prize Category 1 in respect of a Euro Jackpot-Jackpot of € 90.000.000,00 . The Winnings payable in respect of that single Operator Winning Bet in Prize Category 1 would be € 90.000.000,00.

Example 2: There is only one Operator Winning Bet in Prize Category 1 and two Euro Jackpot Winning Tickets Bets have been announced by the DLTB or a co-operator in Prize Category 1 in respect of a Euro Jackpot-Jackpot of € 90.000.000,00. The Winnings payable in respect of that single Operator Winning Bet in Prize Category 1 would be € 30.000.000,00.

Example 3: There are two Operator Winning Bets in Prize Category 1 and one Euro Jackpot Winning Ticket has been announced by the DLTB or a co-operator in Prize Category 1 in respect of a Euro Jackpot-Jackpot of € 90.000.000,00. The Winnings payable in respect of each Operator Winning Bet in Prize Category 1 would be € 45.000.000,00.

11.5.10.

The Winnings to be paid out in respect of each Operator Winning Bet in Prize Category 2 are equal to the amount, which the DLTB or a co-operator would have paid, if the Player had bought a Euro Jackpot Winning Ticket in Prize Category 2 instead. Operator will calculate this amount on the basis of the amount of aggregate stakes published by DLTB or its co-operators as well as the distribution to the Prize Categories or on the basis of the Prizes published on the Website of the DLTB or its co-operators for Prize Category 2 of the relevant draw of “Euro Jackpot”. If no prize is published by DLTB for the Prize Category 2, Bookmaker will fix the prize at € 100.000.

Example 1: There is only one Operator Winning Bet in Prize Category 2 and no Euro Jackpot Winning Ticket has been announced by the DLTB or a co-operator in Prize Category 2 in respect of a theoretical Pay Out of € 1.000.000,00 for one Euro Jackpot Winning Ticket. The Winnings payable in respect of that single Operator Winning Bet in Prize Category 2 would be € 1.000.000,00.

Example 2: There is only one Operator Winning Bet in Prize Category 2 and two Euro Jackpot Winning Tickets Bets have been announced by the DLTB or a co-operator in Prize Category 2 with a Pay Out of € 500.000,00 each. The Winnings payable in respect of that single Operator Winning Bet in Prize Category 2 would be € 333.333,33.

Example 3: There are two Operator Winning Bets in Prize Category 2 and one Euro Jackpot Winning Ticket has been announced by the DLTB or a co-operator in Prize Category 2 with a Pay Out of € 1.000.000,00. The Winnings payable in respect of each Operator Winning Bet in Prize Category 2 would be € 500.000,00.

11.5.11.

The Winnings to be paid out in respect of each Operator Winning Bet in Prize Category 3 are equal to the amount, which the DLTB or a co-operator would have paid, if the Player had bought a Euro Jackpot Winning Ticket in Prize Category 3 instead. Operator will calculate this amount on the basis of the amount of aggregate stakes published by DLTB or its co-operators as well as the distribution to the Prize Categories or on the basis of the Prizes published on the Website of the DLTB or its co-operators for Prize Category 3 of the relevant draw of “Euro Jackpot”. If no prize is published by DLTB for the Prize Category 2, Bookmaker will fix the prize at € 10.000.

The Winnings payable in respect of that single Operator Winning Bet in Prize Category 3 would be € 500.000,00.

Example 2: There is only one Operator Winning Bet in Prize Category 3 and two Euro Jackpot Winning Tickets Bets have been announced by the DLTB or a co-operator in Prize Category 3 with a Pay Out of € 250.000,00 each. The Winnings payable in respect of that single Operator Winning Bet in Prize Category 3 would be € 166.666,67.

Example 3: There are two Operator Winning Bets in Prize Category 3 and one Euro Jackpot Winning Ticket has been announced by the DLTB or a co-operator in Prize Category 3 with a Pay Out of € 500.000,00. The Winnings payable in respect of each Operator Winning Bet in Prize Category 3 would be € 250.000,00.

11.6. EuroMillions

11.6.1.

EuroMillions is a Bookmaker game based on the European “Euro Millionen” European lottery co-organised by the LAE. The “Euro Millionen” draw consists of five numbers (“Winning Numbers”) from 1 to 50, and two supplementary (“Star”) numbers, selected from 1 to 11. Draws are usually held on Tuesdays and Fridays.

11.6.2.

The Player must select five Winning Numbers and two Stars per Bet. At least one Bet is required per Lottery Ticket. Every field which is filled out counts as at least one separate Bet.

11.6.3.

The total price of the numbers selected by the player will be shown on the Virtual Betting Ticket.

11.6.4.

The deadline for purchasing tickets for a draw is determined for each draw and posted on the website.

11.6.5.

If the LAE or its co-operators have not announced a Pay Out in the respective Prize Category for the relevant draw of “Euro Millionen”, the Winnings payable in respect of each Operator Winning Bet in that Prize Category will be calculated by Bookmaker on the basis of the published aggregate amounts paid in for the relevant draw of “Euro Millionen” announced by the LAE or its co-operators and its allocation to the winning Prize Categories. If there have not been any Euro Millionen Winning Tickets in a Prize Category between 3 and 12 in respect of a relevant draw, the calculation for the next lower Prize Category as described in clause 1 and 2 is carried out presuming there had been a Euro Millionen Winning Ticket in the higher Prize Category. Players with Operator Winning Bets for the Prize Categories 4 to 13 are consequently better off as their Winnings would have been smaller, had they bought a Euro Millionen Winning Ticket instead of a Operator Winning Bet.

11.6.8.

The Winnings payable in respect of each Operator Winning Bet in Prize Category 1, 2 and 3 will depend on the number of Euro Millionen Winning Tickets in the relevant Prize Category, the number of Operator Winning Bets in the relevant Prize Category, the payable Prize by the LAE or its co-operators for the Euro Millionen Winning Tickets in the relevant Prize Category as well as the Euro Millionen-Jackpot. A Player with a Operator Winning Bet in Prize Category 1, 2 or 3 will be treated equally by means that their Winnings will be the same as the Pay Out they would have received, had they bought a Euro Millionen Winning Ticket instead of the Operator Winning Bet.

11.6.9.

The Winnings to be paid out in respect of each Operator Winning Bet in Prize Category 1 are equal to the amount, which the LAE or a co-operator would have paid, if the Player had bought a Euro Millionen Winning Ticket in Prize Category 1 instead. Bookmaker will calculate this amount on the basis of the amount of aggregate stakes published by LAE or its co-operators as well as the distribution to the Prize Categories or on the basis of the jackpot published on the Website of the LAE or its co-operators for Prize Category 1 of the relevant draw of “Euro Millionen”. Albeit 11.6.7. (Clause 2) the total of all Winnings payable by Operator for Prize Category 1 for a certain draw must never exceed the Euro Millionen-Jackpot for the relevant draw and might be divided among the winners.

Example 1: There is only one Operator Winning Bet in Prize Category 1 and no Euro Millionen Winning Ticket has been announced by the LAE or a co-operator in Prize Category 1 in respect of a Euro Millionen-Jackpot of € 120.000.000,00. The Winnings payable in respect of that single Operator Winning Bet in Prize Category 1 would be € 120.000.000,00.

Example 2: There is only one Operator Winning Bet in Prize Category 1 and two Euro Millionen Winning Tickets Bets have been announced by the LAE or a co-operator in Prize Category 1 in respect of a Euro Millionen-Jackpot of € 120.000.000,00. The Winnings payable in respect of that single Operator Winning Bet in Prize Category 1 would be € 40.000.000,00.

Example 3: There are two Operator Winning Bets in Prize Category 1 and one Euro Millionen Winning Ticket has been announced by the LAE or a co-operator in Prize Category 1 in respect of a Euro Millionen-Jackpot of € 120.000.000,00. The Winnings payable in respect of each Operator Winning Bet in Prize Category 1 would be € 60.000.000,00.

11.6.10.

The Winnings to be paid out in respect of each Operator Winning Bet in Prize Category 2 are equal to the amount, which the LAE or a co-operator would have paid, if the Player had bought a Euro Millionen Winning Ticket in Prize Category 2 instead. Operator will calculate this amount on the basis of the amount of aggregate stakes published by LAE or its co-operators as well as the distribution to the Prize Categories or on the basis of the Prizes published on the Website of the LAE or its co-operators for Prize Category 2 of the relevant draw of “Euro Millionen”. If no prize is published by LAE for the Prize Category 2, Bookmaker will fix the prize at € 100.000.

Example 1: There is only one Operator Winning Bet in Prize Category 2 and no Euro Millionen Winning Ticket has been announced by the LAE or a co-operator in Prize Category 2 in respect of a theoretical Pay Out of € 500.000,00 for one Euro Millionen Winning Ticket. The Winnings payable in respect of that single Operator Winning Bet in Prize Category 2 would be € 500.000,00.

Example 2: There is only one Operator Winning Bet in Prize Category 2 and two Euro Millionen Winning Tickets Bets have been announced by the LAE or a co-operator in Prize Category 2 with a Pay Out of € 250.000,00 each. The Winnings payable in respect of that single Operator Winning Bet in Prize Category 2 would be € 166.666,67.

Example 3: There are two Operator Winning Bets in Prize Category 2 and one Euro Millionen Winning Ticket has been announced by the LAE or a co-operator in Prize Category 2 with a Pay Out of € 500.000,00. The Winnings payable in respect of each Operator Winning Bet in Prize Category 3 would be € 250.000,00.

11.6.11.

The Winnings to be paid out in respect of each Operator Winning Bet in Prize Category 3 are equal to the amount, which the LAE or a co-operator would have paid, if the Player had bought a Euro Millionen Winning Ticket in Prize Category 3 instead. Operator will calculate this amount on the basis of the amount of aggregate stakes published by LAE or its co-operators as well as the distribution to the Prize Categories or on the basis of the Prizes published on the Website of the LAE or its co-operators for Prize Category 3 of the relevant draw of “Euro Millionen”. If no prize is published by LAE for the Prize Category 2, Bookmaker will fix the prize at € 10.000.

Example 2: There is only one Operator Winning Bet in Prize Category 3 and two Euro Millionen Winning Tickets Bets have been announced by the LAE or a co-operator in Prize Category 3 with a Pay Out of € 50.000,00 each. The Winnings payable in respect of that single Operator Winning Bet in Prize Category 3 would be € 33.333,33.

Example 3: There are two Operator Winning Bets in Prize Category 3 and one Euro Millionen Winning Ticket has been announced by the LAE or a co-operator in Prize Category 3 with a Pay Out of € 100.000,00. The Winnings payable in respect of each Operator Winning Bet in Prize Category 3 would be € 50.000,00.

11.7. PowerBall

11.7.1.

PowerBall is a Bookmaker game based on the American “Powerball” lottery organised by the Multi-State Lottery Association (MUSL). The “Powerball” draw consists of five numbers (“Winning Numbers”) from 1 to 59, and a supplementary (“Powerball”) number from 1 to 35. Draws are usually held every Thursday and Sunday (UK Time).

11.7.2.

The Player must select five Numbers and one Powerball per Bet. At least one Bet is required per Virtual Betting Ticket. If the “PowerPlay” option is selected, payouts in Prize Categories 2 to 9 increase as per section 11.7.7. of this document. Every field which is filled out counts as at least one separate Bet.

11.7.3.

The Stake is displayed on the Virtual Betting Ticket.

11.7.4.

The deadline for participating in a draw is determined for each respective draw, and will be posted on the Website.

11.7.5.

There are 9 ways to win:

  • by matching the Powerball (Prize Category 9)

11.7.6.

11.7.7.

The Winnings payable in respect of each Operator Winning Bet in Prize Categories 2 to 9 corresponds to the winnings announced by the MUSL for a Powerball Winning Ticket. 

In general, these are the prizes for an Operator Winning Bet without the “PowerPlay” option:

  • $ 4,00 for Prize Category 9
  • $ 4,00 for Prize Category 8
  • $ 7,00 for Prize Category 7
  • $ 7,00 for Prize Category 6
  • $ 100,00 for Prize Category 5
  • $ 100,00 for Prize Category 4
  • $ 10.000,00 for Prize Category 3
  • $ 1.000.000,00 for Prize Category 2

Winnings in Prize Categories 3 to 9 with the “PowerPlay” option will be multiplied by 2, 3, 4 or 5, depending on the multiplier number drawn and are not subject to withholdings as they are below the threshold. Winnings in Prize Category 2 with the "PowerPlay" option will be multiplied by 2. In addition, all Winnings in Prize Category 2 with or without the „PowerPlay" option are subject to 35% withholdings as described in 11.7.9.

11.7.8.

The Winnings payable in respect of each Operator Winning Bet in Prize Category 1 will depend on the number of Powerball Winning Tickets in the relevant Prize Category, the number of Operator Winning Bets in the relevant Prize Category, the payable Prize by the MUSL or a co-organiser for the Powerball Winning Tickets in the relevant Prize Category, the withholdings, and the Powerball-Jackpot.

11.7.9.

The Winnings to be paid out in respect of each Operator Winning Bet in Prize Category 1 are equal to the amount which the MUSL or a co-operator would have paid, if the Player had bought a Powerball Winning Ticket in Prize Category 1 instead, less 35% withholdings. Bookmaker will calculate this amount on the basis of the amount of aggregate stakes published by MUSL or its co-operators as well as the distribution to the Prize Categories or on the basis of the Powerball-Jackpot published on the Website of the MUSL or its co-operators for Prize Category 1 of the relevant draw of “Powerball”. The total of all Winnings payable by Bookmaker for Prize Category 1 for a certain draw must in this case never exceed the Powerball-Jackpot for the relevant draw and might be divided among the winners. 

Withholdings are retained by the Bookmaker because it is intended that a Player at the Site playing PowerBall is put in the same or in a better economic position as if they had played the underlying lottery. When playing and winning the underlying lottery Power Ball, at least 35% taxes are withheld by the federal government. Thus, the Player is treated equally in both cases.

Example 1: There is only one Operator Winning Bet in Prize Category 1 and no Powerball Winning Ticket has been announced by the MUSL or a co-operator in Prize Category 1 in respect of a Powerball-Jackpot of $ 300.000.000,00. The Winnings payable after withholdings in respect of that single Operator Winning Bet in Prize Category 1 would be $ 195.000.000,00. This is the maximum sum the Player would have received, had he played and had he won the underlying lottery Power Ball as the only winner.

Example 2: There is only one Operator Winning Bet in Prize Category 1 and two Powerball Winning Tickets Bets have been announced by the MUSL or a co-operator in Prize Category 1 in respect of a Powerball-Jackpot of $ 300.000.000,00. The Winnings payable after withholdings in respect of that single Operator Winning Bet in Prize Category 1 would be $ 65.000.000,00. This is the maximum sum the Player would have received, had he played and had he won the underlying lottery Power Ball as one of three winners. 

Example 3: There are two Operator Winning Bets in Prize Category 1 and one Powerball Winning Ticket has been announced by the MUSL or a co-operator in Prize Category 1 in respect of a Powerball-Jackpot of $ 300.000.000,00. The Winnings payable after withholdings in respect of each Operator Winning Bet in Prize Category 1 would be $ 97.500.000,00. This is the maximum sum the Player would have received, had he played and had he won the underlying lottery Power Ball as one of two winners. 

11.7.10.

As is common with the American “Powerball” lottery, the Bookmaker also pays out the Winnings in Prize Category 1 over 30 years (the “Annuity Option”). The first payment will be made as soon as possible after the draw, with the next 29 payments at one-year intervals. The level of payments is calculated such that the payments rise 4% from year to year until the full sum has been paid out. The option to receive one lump sum (“Cash Option”) is not yet available at Operator. According to section 6.2., Winnings are converted only once into the reference currency on the day of the draw. All subsequent payments are also subject to the same exchange rate.

11.8. MegaMillions

11.8.1.

MegaMillions is a Bookmaker game based on the American “Mega Millions” lottery conducted by the Mega Millions Consortium and co-hosted by the Multi-State Lottery Association (MUSL). The MegaMillions draw consists of five numbers (“Winning Numbers”) from 1 to 75, and a supplementary (“MegaBall”) number from 1 to 15. Additionally, before each MegaMillions draw, the “MegaPlier” number (2, 3, 4 or 5) is drawn by computer. The MegaPlier numbers are weighted: the MegaPlier number 2 by 13.3%, the MegaPlier number 3 by 26.7%, the MegaPlier number 4 by 20.0%, and the MegaPlier number 5 by 40.0%. Draws are usually held every Wednesday and Saturday (UK Time).

11.8.2.

The Player must select five Winnings Numbers and one Megaball per Bet. At least one Bet is required per Virtual Betting Ticket. If the “MegaPlier” option is selected, payouts in Prize Categories 2 to 9 double, triple, quadruple or quintuple depending on the official Megaplier number drawn. Every field which is filled out counts as at least one separate Bet.

11.8.3.

The Stake is displayed on the Virtual Betting Ticket page.

11.8.4.

The deadline for participating in a draw is determined for each respective draw, and will be posted on the Website.

11.8.5.

There are 9 ways to win (9 Prize Categories):

  • by matching the Megaball (Prize Category 9)
  • by matching a Winning Number and the Megaball (Prize Category 8)
  • by matching two Winning Numbers and the Megaball (Prize Category 7)
  • by matching three Winning Numbers (Prize Category 6)
  • by matching three Winning Numbers and the Megaball (Prize Category 5)
  • by matching four Winning Numbers (Prize Category 4)
  • by matching four Winning Numbers and the Megaball (Prize Category 3)
  • by matching five Winning Numbers (Prize Category 2)
  • by matching five Winning Numbers and the Megaball (Prize Category 1)

11.8.6.

Only one Prize Category can be won per Bet, which will be the highest of the available Prize Categories achieved by, and relevant to, that Bet.

11.8.7.

The Winnings payable in respect of each Operator Winning Bet in Prize Categories 2 to 9 corresponds to the winnings announced by the Mega Millions Consortium or the MUSL or the co-organisers for a Mega Millions Winning Ticket. 

In general, these are the prizes for an Operator Winning Bet without the “MegaPlier” option:

  • $ 1,00 for Prize Category 9
  • $ 2,00 for Prize Category 8
  • $ 5,00 for Prize Category 7
  • $ 5,00 for Prize Category 6
  • $ 50,00 for Prize Category 5
  • $ 500,00 for Prize Category 4
  • $ 5.000,00 for Prize Category 3
  • $ 1.000.000,00 for Prize Category 2

Winnings in Prize Categories 2 to 9 with the "MegaPlier" option will be multiplied by 2, 3, 4 or 5, depending on the Megaplier number drawn. In addition, all Winnings in Prize Category 2 are subject to 35% withholdings as described in 12.8.5. as they are above the tax threshold.

11.8.8.

The Winnings payable in respect of each the Operator’s Winning Bet in Prize Category 1 will depend on the number of Mega Millions Winning Tickets in the relevant Prize Category, the number of Operator Winning Bets in the relevant Prize Category, the payable Prize by the Mega Millions Consortium, MUSL, or a co-organiser for the Mega Millions Winning Tickets in the relevant Prize Category, the withholdings, and the Mega Millions-Jackpot.

11.8.9.

The Winnings to be paid out in respect of each Operator Winning Bet in Prize Category 1 are equal to the amount which the Mega Millions Consortium, MUSL or a co-operator would have paid, if the Player had bought a Mega Millions Winning Ticket in Prize Category 1 instead, less 35% withholdings. The Bookmaker will calculate this amount on the basis of the amount of aggregate stakes published by the Mega Millions Consortium, MUSL or its co-operators as well as the distribution to the Prize Categories or on the basis of the Mega Millions-Jackpot published on the Website of the Mega Millions Consortium, MUSL or its co-operators for Prize Category 1 of the relevant draw of “Mega Millions”. The total of all Winnings payable by Bookmaker for Prize Category 1 for a certain draw must in this case never exceed the Mega Millions-Jackpot for the relevant draw and might be divided among the winners. 

Withholdings are retained by the Bookmaker because it is intended that a Player at the Site playing MegaMillions is put in the same, or in a better, economic position as if they had played the underlying lottery. When playing and winning the underlying lottery Mega Millions, at least 35% taxes are withheld by the federal government. Thus, the Player is treated equally in both cases. 

Example 1: There is only one Operator Winning Bet in Prize Category 1 and no Mega Millions Winning Ticket has been announced by the Mega Millions Consortium, MUSL, or a co-operator in Prize Category 1 in respect of a Mega Millions-Jackpot of $ 300.000.000,00. The Winnings payable after withholdings in respect of that single Operator Winning Bet in Prize Category 1 would be $ 195.000.000,00. This is the maximum sum the Player would have received, had he played and had he won the underlying lottery Mega Millions as the only winner. 

Example 2: There is only one Operator Winning Bet in Prize Category 1 and two Mega Millions Winning Tickets have been announced by the Mega Millions Consortium, MUSL, or a co-operator in Prize Category 1 in respect of a Mega Millions-Jackpot of $ 300.000.000,00. The Winnings payable after withholdings in respect of that single Operator Winning Bet in Prize Category 1 would be $ 65.000.000,00. This is the maximum sum the Player would have received, had he played and had he won the underlying lottery Mega Millions as one of three winners. 

Example 3: There are two Operator Winning Bets in Prize Category 1 and one Mega Millions Winning Ticket has been announced by the Mega Millions Consortium, MUSL, or a co-operator in Prize Category 1 in respect of a Mega Millions-Jackpot of $ 300.000.000,00. The Winnings payable after withholdings in respect of each Operator Winning Bet in Prize Category 1 would be $ 97.500.000,00. This is the maximum sum the Player would have received, had he played and had he won the underlying lottery Mega Millions as one of two winners.

11.8.10.

As is common with the American “Mega Millions” lottery, the Bookmaker also pays out the Winnings in Prize Category 1 over 30 years (the “Annuity option”) in equal instalments. The first payment will be made as soon as possible after the draw, with the next 29 payments at one-year intervals. The level of payments is calculated such that the payments rise 4% from year to year until the full sum has been paid out. The option to receive one lump sum (“Cash Option”) is not yet available at the Operator. According to section 10.16., Winnings are converted only once into the reference currency on the day of the draw. All subsequent payments are also subject to the same exchange rate.

11.10 Superenalotto

11.10.1.

“SuperEnalotto” is a Bookmaker game based on the most popular national lottery game in Italy. The SuperEnalotto draw consists of six numbers (“Winning Numbers”) from 1 to 90, and a Jolly number drawn from the remaining 84 numbers in the drum. Draws are usually held every Tuesday, Thursday and Saturday 18:30 CET time.

11.10.2.

The Player must select six Winnings Numbers. At least one Bet is required per Virtual Betting Ticket. Every field which is filled out counts as at least one separate Bet.

11.10.3.

The Stake is displayed on the Virtual Betting Ticket page.

11.10.4.

There are 5 ways to win (5 Prize Categories):

  • by matching three Winning Numbers (Prize Category 5)

11.10.6.

The Winnings payable in respect of each Operator Winning Bet in Prize Categories 2 to 5 corresponds to the winnings announced by the Sisal Spa, Italian organizer or the co-organisers for a SuperEnalotto Winning Ticket. 

11.10.8.

The Winnings payable in respect of each the Operator’s Winning Bet in Prize Category 1 will depend on the number of SuperEnalotto Winning Tickets in the relevant Prize Category, the number of Operator Winning Bets in the relevant Prize Category, the payable Prize by the Sisal Spa or a co-organiser for the SuperEnalotto Winning Tickets in the relevant Prize Category, the withholdings, and the SuperEnalotto-Jackpot.

11.10.9.

The Winnings to be paid out in respect of each Operator Winning Bet in Prize Category 1 are equal to the amount which the Sisal Spa or a co-operator would have paid, if the Player had bought a SuperEnalotto Winning Ticket in Prize Category 1 instead. The Bookmaker will calculate this amount on the basis of the Mega Millions-Jackpot published on the Website of Sisal Spa, or its co-operators for Prize Category 1 of the relevant draw of “SuperEnalotto”. The total of all Winnings payable by Bookmaker for Prize Category 1 for a certain draw must in this case never exceed the SuperEnalotto-Jackpot for the relevant draw and might be divided among the winners. 

Example 1: There is only one Operator Winning Bet in Prize Category 1 and no SuperEnalotto Winning Ticket has been announced by the Sisal Spa or a co-operator in Prize Category 1 in respect of a theoretical Pay Out of € 500.000,00 for one SuperEnalotto Winning Ticket. The Winnings payable in respect of that single Operator Winning Bet in Prize Category 1 would be € 500.000,00. 

Example 2: There is only one Operator Winning Bet in Prize Category 1 and two SuperEnalotto Winning Tickets Bets have been announced by the Sisal Spa or a co-operator in Prize Category 1 with a Pay Out of € 250.000,00 each. The Winnings payable in respect of that single Operator Winning Bet in Prize Category 3 would be € 166.666,67. 

Example 3: There are two Operator Winning Bets in Prize Category 1 and one SuperEnalotto Winning Ticket has been announced by the Sisal Spa or a co-operator in Prize Category 1 with a Pay Out of € 500.000,00. The Winnings payable in respect of each Operator Winning Bet in Prize Category 3 would be € 250.000,00.

11.11 Syndicate Games

11.11.1.

A lottery syndicate is a group of individuals who choose to play the same number combinations together as a group. All winnings from lines played by the syndicate will be shared between all the active members of the syndicate, depending on the amount of shares each individual has.

11.11.2.

Euro Combi play will allow you to be entered into a Tuesday and Friday EuroMillions draw, with 55 lines in each; and a Friday-night EuroJackpot draw with 45 lines. Any winnings from the 155 lines played in total will be divided between the shares in group.

11.11.3

A share refers to the percentage of prize winnings a player is entitled to in syndicate lottery play. The Euro Combi has a maximum of 88 shares.

11.11.4

US Combi play will allow you to be entered into the Wednesday and Saturday MegaMillions draws, with 15 lines in each; and a Thursday and Sunday Powerball draw with 35 lines in each. Any winnings from the 100 lines played in total will be divided by the number of shares in the syndicate. As our syndicates play all Mega and Powerball combinations, it means there is going to be a winning bet in every draw.

11.11.5.

A share refers to the percentage of prize winnings a player is entitled to in syndicate lottery play. The US Combi has a maximum of 93 shares.

11.11.6.

VIP World Combi play will allow you to be entered into two MegaMillions draws with 15 lines in each; two Powerball draws with 35 lines in each; one EuroJackpot draw with 45 lines; two EuroMillions draws with 55 lines in each; three SuperEnalotto draws with 85 lines in each; and two Lotto 6/49 draws with 10 lines in each. Any winnings from the 530 lines played in total will be divided by the number of shares in the syndicate. As our syndicates play all Lucky-Star, Euro-number, Megaball, Powerball, Superball combinations, it means there is going to be a winning bet in every draw.

11.11.7.

A share refers to the percentage of prize winnings a player is entitled to in syndicate lottery play. The VIP World has a maximum of 133 shares.

11.11.8.

Players participating in a syndicate will receive an email directly after each draw informing them of all their winnings. A Player can also login to the Player Account at any time and check their latest winnings.

11.12 BoosterBall

11.12.1

Boosterball is designed to provide the Player with the option to generate winnings that are much better than those generated by the Bookmaker game when 3 numbers are matched.

11.12.2

Prizes offered range from €1000 to €10,000 and the Winnings would depend on the Stake amount selected using the Boost ‘o’ Meter Slider on the website.

11.12.3.

By selecting the Boosterball option, after having selected the numbers on a Virtual Betting Ticket, if three numbers are matched to the numbers drawn in the respective Lottery, the Player will win the amount displayed when choosing the stake amount using the Boost’o’meter, additionally to the normal payout for that prize category.

11.13 General Betting Rules

11.13.1.

The Bookmaker strives to ensure that all the jackpot values for all lotteries offered on the Website are correct, but assumes no responsibility for errors contained in such information. The Bookmaker estimates the amount of future jackpots using certain assumptions, such as the current or future jackpot being won or rolled over, but is not liable for false assumptions, calculations or forecasts.

11.13.2

By choosing the option “Jackpot Chaser” the Player may automatically choose to extend the Virtual Betting Ticket until the current jackpot of the highest Prize Category in respect to the underlying lottery of the relevant Bookmaker game has been won. The period for withdrawal encloses only the next draw date.

11.13.3

Valid Bets will be placed on the next relevant draw that takes place, provided that they are placed before the respective deadline and provided that the Player has not selected something else on purpose. The deadline will be displayed on the Website. It is up to the Player to make sure that the instructions are given to place the Bet before the relevant deadline. For the avoidance of doubt, instructions to place or the apparent placement of a Bet after the start of a specific draw or a draw that has actually occurred will not be valid, irrespective of any automatic confirmation, that may be generated via email or the Website, or irrespective of a wrong deadline displayed on the Website.

11.13.4

The “When Jackpot” feature will set Bets to enter/play a particular lottery only after the official lottery Prize Category 1 has exceeded the specified “When Jackpot” amount for the relevant draw.

11.13.5

If a lottery makes multiple draws on the same date, then unless otherwise specified by the Bookmaker, a Player's Bet will apply only to the main draw taking place on that date (or, where no main draw takes place, the first draw), under exclusion of any other draw made by the lottery in question.

11.13.6

If a lottery draw does not take place or no draw result is published or officially announced, all valid Bets on that draw will stand for the rescheduled draw (or, if there is none, the next available relevant draw).

11.13.7

The Operator shall pay out winnings up to 50 million units (Euro, $, etc) as one lump sum, any winnings over this amount shall be paid to the winner/s in equal yearly installments over a period of thirty (30 years).

12. Rights of the Bookmaker

12.1.

A Player cannot claim any Winnings or payout from the Bookmaker and/or Bookmaker may at its discretion decide about the validity of a Bet or a Player's entitlement to Winnings or void a Bet if

  1. Bets were placed after the relevant deadline or after the start of the relevant draw;
  2. Bets were erroneously accepted after the relevant deadline or if the relevant draw had already begun or taken place;
  3. The Bookmaker becomes aware of an error in relation to that Bet or draw and is not able to contact the Player to correct the error or confirm the bet before the deadline;
  4. the Bet was placed on behalf of a Player who has provided false information in connection with their Player Account or otherwise in connection with the Website or the services available through it;
  5. the Bet was placed on behalf of a Player who has been involved in any fraud-related activities in relation to the placing of the bet, the operation of the Player Account or otherwise in connection with the Website or the services available through it;
  6. the Bet was placed on behalf of a Player who was less than 18 years old or was a director, officer, or employee (or their spouse or dependent) of the Bookmaker or of one of the Operator Group companies;
  7. the Player maintains more than one Player Account;
  8. in conjunction with any draw, fraud, technical and/or human error or unwarranted influence was found or
  9. the draw is declared by an organiser or co-organiser as being invalid.

Furthermore the Bookmaker may void a Bet if the Operator authorises or instructs it to do so.

12.2.

When deciding if Winnings are to be paid out due to 12.1., Bookmaker may base its decision on information that is researched and/or held by Operator and forwarded to the Bookmaker. The Bookmaker is not obliged to carry out investigation on its own.

12.4.

If any Bet is voided in accordance with Condition 12.1. (i), (ii), or (iii), the Bookmaker will offer the Operator, on behalf of the Player, the option of placing any such Bet on the next relevant draw or crediting the Player's Player Account with the relevant sum. If any Bet is otherwise voided by the Operator in accordance with these terms, the relevant sum associated with that bet may be forfeited to the Bookmaker, or except where the Bet was placed by a Player who is under the age of 18. In this case, the relevant sum will be repaid to the Operator on behalf of the Player.

12.5.

The Bookmaker reserves the right:

  1. a) to set off the amounts of any unpaid Bets for Bets owed by that Player against a Player's Winnings;
  2. b) to terminate, vary or suspend any product offered on the Website, immediately and without prior notice, for any reason and at the Bookmaker’s sole discretion; and
  3. c) to require that, but shall not be obliged, the relevant Player provide identification documents in order to enable the Bookmaker to satisfy itself as to the validity of Player Account details and the Player's entitlement to the Winnings in accordance with these Terms and Conditions. The Bookmaker may withhold payment of Winnings until any such matter has been fully resolved.

12.6.

The Bookmaker decides about acceptance of a Player’s Bet prior to the beginning of the draw. If the Bookmaker does not accept a Bet, the Player will be reimbursed accordingly.

12.7

The Operator has the right to hedge against placed Bets by purchasing tickets in its own name or its representatives names in corresponding lotteries in which Players would have placed bets, irrespective of whether the Prizes on offer are insured or not.

14. Commitment to Decisions

14.1.

In the event of a dispute in respect of a Bet or the payment or awarding of any Winnings, the Bookmaker may withhold payment of the Winnings until any dispute has been fully concluded.

14.2.

Where the Bookmaker makes a final decision or exercises any discretion referred to above, the Bookmaker may, solely at its discretion and notwithstanding Condition 13, reimburse the sum paid by the Player for the relevant Bet or offer a new Bet to the Player.

17. Liability of Bookmaker

17.1.

The Bookmaker shall not be liable for any loss or damage that may arise from the insolvency of third parties, including the Operator or any bank, including (without limitation) any bank with which the Bookmaker maintains its accounts.

17.2.

The Bookmaker’s liability to the Player and/or in regards to the Player’s Winnings is fully discharged upon payment being made by the Bookmaker to the Operator. For clarification: the Bookmaker is, under no circumstances, obliged to pay Winnings directly to Players, or to any party other than the Operator. The Bookmaker is furthermore not obliged to payout Winnings, if the Player has no such claim according to these Terms and Conditions.

17.3.

Any liability that the Bookmaker has towards a Player other than an obligation to pay Winnings to the Operator on behalf of the Player for successful and valid Bets placed by the Operator on behalf of the Player and submitted and accepted according to these Terms and Conditions is limited:

  • in the case that the liability refers to a Bet: to the total amount of the Player’s Stake in regards to that specific Bet
  • in all other cases: to the amount of Euro 5.000,00 (five thousand Euros).
